SMOKERS, BEWARE!
Most people know about the Smoking Ban in enclosed public places which came into force in July.
If you are in charge of smoke-free premises, you have a legal responsibility to prevent people from smoking in them.
If someone does smoke on your premises, here are a few tips on how to deal with them.
- Point to the no-smoking signs and ask the person to stop smoking or go outside.
- Remind them the new law is to protect everyone from the harmful effects of their secondhand smoke.
- Tell them you would be committing an offence if you allowed them to smoke, and they are breaking the law by smoking in a smoke-free premises. Tell them that both they and you could be fined.
- If they won't stop smoking or go outside: In a public place: Explain that staff will refuse to serve them if they continue to smoke, and they will be asked to leave your premises. Then, if necessary, Implement your normal procedure for anti-social or illegal behaviour. In the work place: Put into practice your disciplinary procedure for non-compliance with your company's smoke-free policy.
- Keep a record of where and when the incident took place, the name of the person involved and the outcome.
- If the smoker threatens physical violence, we recommend you notify and/or contact the Police.
